5.Third-party lenders

When you submit the loan application form on this Site, your information is transmitted to third-party lending platforms and lenders (including but not limited to APIdiamond.com and its lender network). We are not the lender. We do not control third-party lender decisions, underwriting criteria, loan terms, interest rates, fees, or customer service.

Any loan agreement is between you and the third-party lender. We are not party to that agreement and are not responsible for its terms, performance, or dispute resolution. You should review all loan documents carefully before signing.

We are not Integra Credit, Deinde Financial LLC, or any affiliated entity. For issues related to an existing Integra Credit account, contact the lender directly at 855-345-5550 or integracredit.com.

6.Affiliate compensation

7.User conduct

You agree not to:

WE DO NOT WARRANT THAT:

• Any rates, terms, or lender practices described are still in effect
• Results obtained from Site use will meet your requirements
• Any errors in the Site will be corrected

10.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTEGRA CREDIT USA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRIBUTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY INFORMATION OBTAINED FROM IT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED US DOLLARS ($100).

12.Dispute resolution and arbitration

12.1 Informal resolution first

Before filing any formal claim, you agree to contact us at legal [at] integracreditusa [dot] com and attempt to resolve the dispute informally for at least 60 days.

12.2 Binding arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or your use of the Site shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in English and take place in the United States.

12.3 Class action waiver

You and we agree that disputes will be resolved on an individual basis and not as part of any class action, consolidated action, or representative proceeding.

12.4 Exception for small claims and injunctive relief

Notwithstanding the above, either party may bring an individual action in small claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

12.5 30-day opt-out

You may opt out of this arbitration clause by sending a written notice to legal [at] integracreditusa [dot] com within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you are opting out of arbitration.

13.Governing law

These Terms are governed by the laws of the United States and the state in which our operating entity is registered, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14.Miscellaneous

14.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.2 Entire agreement

These Terms, together with our Privacy Policy and Advertising Disclosures, constitute the entire agreement between you and us regarding the Site and supersede all prior agreements.

14.3 No waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

14.5 Notices

14.6 Force majeure

We are not liable for delays or failures in performance caused by events outside our reasonable control, including acts of God, war, terrorism, strikes, internet outages, or governmental actions.
